1. Who we are

Setmark is a construction document review platform operated by Cruz Enterprise Group LLC, a Texas limited liability company. This policy explains what information we collect, how we use it, and the choices you have. Questions? Contact privacy@setmark.ai.

2. What this policy covers

This policy applies to our website and to the Setmark platform. It covers visitors who browse our website or request a demo, and customers and their users who upload construction documents for review. Where a customer uses Setmark to process documents, that customer controls the content and we process it on their behalf.

3. Information we collect

Information you give us

  • Demo and contact requests: your name, work email, company, role, and anything you write in the message field.
  • Account information for platform users, such as name, email, and organization.
  • Correspondence you send us by email.

Customer content

Platform users upload construction documents, including plan sets, drawings, and related project files. We process this content to run reviews, produce findings, and provide support. We do not use customer content for advertising, and we do not sell it.

Information collected automatically

  • Usage and device data such as IP address, browser type, pages viewed, referring page, and timestamps.
  • Cookies and analytics as described in Section 5.
  • Server logs used for security and troubleshooting.

4. How we use information

  • To provide, operate, and improve the Setmark platform.
  • To respond to demo requests, questions, and support issues.
  • To run document reviews and generate findings for the customer who submitted them.
  • To monitor security, prevent abuse, and troubleshoot problems.
  • To comply with legal obligations and enforce our agreements.

Where a legal basis is required, we rely on performance of a contract, our legitimate interests in operating and securing the service, your consent where we ask for it, and compliance with legal obligations.

5. Cookies and analytics

We use Google Analytics 4 to understand how the website is used. Google Analytics sets cookies and collects information such as pages viewed, approximate location, and device details.

Analytics only runs if you accept it. When you first visit, we show a consent banner. Analytics cookies are not loaded unless you choose Accept. You can change your mind by clearing your browser storage for this site, which restores the banner on your next visit. Cookies strictly necessary to operate the site are always active.

6. How we share information

We do not sell your personal information, and we do not share it for cross context behavioral advertising. We share information only with service providers who host and run the platform under contract, professional advisors where reasonably needed, for legal reasons where required by law, and in a business transfer subject to this policy.

7. AI processing of documents

Setmark uses automated and AI assisted analysis to perform a first pass review and surface likely issues. Findings are suggestions that require human review. A qualified person on the customer team verifies, corrects, or clears every finding. Setmark does not make final decisions about your documents.

Where we use third party AI model providers to process customer content, we do so under contract terms intended to keep that content confidential and prevent its use to train publicly available models.

8. Data retention

We keep information for as long as needed to provide the service and for legitimate business or legal purposes. Customer content is retained according to the customer agreement and configuration, and is deleted on request subject to legal and backup constraints.

9. Security

We use administrative, technical, and physical safeguards designed to protect information, including encryption in transit, access controls, and hosting on established cloud infrastructure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Your rights and choices

  • Know what personal information we hold about you and request access to it.
  • Request correction of inaccurate information.
  • Request deletion of your information.
  • Request a portable copy of your information.
  • Opt out of the sale or sharing of personal information. We do not sell or share it.
  • Appeal a decision we make about your request.

Texas residents have these rights under the Texas Data Privacy and Security Act. California residents have rights under the CCPA as amended by the CPRA. Residents of the EEA and UK have rights under the GDPR. To exercise any right, email privacy@setmark.ai. We will verify your request, respond within the time required by law, and will not discriminate against you for exercising your rights.

11. International transfers

We operate in the United States and our service providers may process information in the United States and other countries. If you access Setmark from outside the United States, your information may be transferred to and processed in the United States.

12. Children

Setmark is a business tool and is not directed to children. We do not knowingly collect personal information from anyone under 18.

13. Changes to this policy

We may update this policy from time to time. When we do, we will revise the effective date at the top. If changes are significant, we will provide additional notice.
